If the order form has been sent and the price has been paid for items that are no longer available, SCARAB will refund the amount paid for those items, without undue delay, and the contract between the parties will be deemed to have been terminated.

2.7 By submitting an order form to SCARAB, you unconditionally accept and undertake to observe the provisions of these Terms & Conditions in your contract with SCARAB. Should you not agree with certain provisions of these Terms & Conditions, please do not submit your order form for the purchase of products on SCARAB-COSMETICS.COM.

2.8 Once the contract has been entered into, SCARAB will send you by email a receipt for the purchase order. By submitting an order form, you agree and accept these Terms and Conditions as well as further conditions contained on SCARAB-COSMETICS.COM, including the Returns Policy and Privacy Policy.

2.9 We would like to remind you that all items purchased are intended for use in the country they were ordered from. If, however, you decide to take the items to another country, you will be responsible for adhering to both the exportation legislation of the order country and the importation legislation of the destination country. SCARAB shall not be held liable.

3. Products & Prices

3.1 On SCARAB-COSMETICS.COM, we offer for sale high-end, organic, clean and vegan products.

The Products – cosmetics products are not food products and cannot be used for human consumption. SCARAB has taken all necessary steps to ensure that the design of the cosmetics products sold and, in particular, their type, smell, colour, appearance, amount or size is not confused with food products and does not pose a risk to human health and safety.

The product consists of natural ingredients included in cosmetics and is a safe for human life, health and environment, which complies with the relevant applicable international laws.

3.3 Prices are subject to change. Check the final price of sale before sending the relevant order form.

3.4 Orders made from a country site different from the one you are shipping to, or to addresses to which SCARAB cannot ship, will be automatically cancelled.

3.5 In accordance with consumer protection legislation, you will be liable for any decrease in the value of products purchased on SCARAB-COSMETICS.COM resulting from any use of the same products other than that which is necessary to verify their nature, characteristics and functionality. Therefore, should you decide to exercise your right to return purchased products, SCARAB has the right to not accept returned products or to not fully refund the amounts paid for purchased products that have been altered from their original status or damaged.

4. Payments

Under no circumstances will you be charged costs that are higher than those actually incurred by SCARAB, in relation to your previously selected payment method.

4.2 In case of payment by credit card or debit card, all details (for example, card number or expiration date) will be sent by encrypted protocol to the corresponding bank which provides remote electronic payment services, without third parties having any access whatsoever thereto. Such details will not be used by SCARAB except for performing the procedure relevant to your purchase or issuing refunds in the case of returns, in compliance with the exercise of your right to return products purchased, or for reporting cases of fraud to the police. The price for the purchase of products and the relevant costs for shipping and delivery, as indicated on the order form, will be charged to your account when the purchased products are actually shipped.

5. Discount Codes

5.1 Discount codes are personalized codes which allow you to take advantage of a discount on your purchase on SCARAB-COSMETICS.COM.

5.3 Discount codes cannot under any circumstances be exchanged for money.

5.4 You may not use more than one discount code per order.

7. Right to withdraw in accordance with consumer protection law

7.1 In accordance with consumer protection legislation, you may return products purchased from SCARAB-COSMETICS.COM, without any penalty and without specifying the reason, within fourteen (14) days of receiving the products purchased on SCARAB-COSMETICS.COM.

7.2 Once you have exercised your right to withdraw from the contract, you must return the products to SCARAB, sending them to the shipping agent for shipment within fourteen (14) days of when you informed SCARAB of your decision to withdraw from the contract.

15. Term and Termination

16. Applicable Legislation

When implementing this agreement, the Parties shall accept as the main principle the mutual understanding or reasonable compromise. To that effect, the Parties agree to solve any disputes between them in the spirit of goodwill and through negotiations.

Any dispute, argument or claim arising from or related to the implementation or lack of implementation, respectively, should be solved by the Parties through negotiations and with the goodwill of both.

In the event of impossibility to solve the disputes arising from or due to this agreement, its implementation or lack of implementation, respectively, the Parties accept to refer those disputes to the respective competent court determined according to the jurisdiction rules. In case of private dispute with an international element, the court which is competent to hear the case should be determined according to the rules of private international law.

The applicable legislation and court under this agreement shall the legislation of the country where the controller is registered, namely the Republic of Bulgaria.
